1. INTRODUCTION AND ACCEPTANCE OF TERMS
Welcome to Unknown Server. These Terms of Service (hereinafter referred to as the "Terms") constitute a legally binding agreement between you (hereinafter referred to as the "Client", "User", or "you") and Unknown Server (hereinafter referred to as "Unknown Server", "we", "us", or "our"), operator of the website unknownserver.app and provider of hosting services and related services.
By accessing, registering, or using any of our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to any of these terms, you must not use our services.
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or notice on our website. Continued use of our services after such changes constitutes your acceptance of the modified Terms.
2. DEFINITIONS
"Services" refers to all products and services offered by Unknown Server, including but not limited to: Shared Web Hosting, Reseller Hosting, VPS Servers, Dedicated Servers, SSL Certificates, Domain Registration, Email Services, Website Builders, Web Security Services, Backups, and VPN Services.
"Account" means the user account you create to access and use our Services.
"User Content" refers to all data, files, text, images, software, scripts, and any other material that you store, transmit, or process through our Services.
"Acceptable Use Policy" or "AUP" refers to the rules and restrictions on the use of our Services set forth in Section 6 of these Terms.
3. SERVICE DESCRIPTION
3.1 Shared Web Hosting
We offer shared web hosting services where multiple client accounts share the resources of a server. Plans include disk space, bandwidth, email accounts, and databases according to the specifications of the contracted plan.
3.2 Reseller Hosting
Reseller plans allow clients to resell hosting services under their own brand. The Reseller Client is responsible for providing support to their own customers and ensuring they comply with our Terms.
3.3 VPS Servers (Virtual Private Server)
VPS servers provide a dedicated virtualized environment with guaranteed resources. The client has root/administrator access and is responsible for the management and security of their virtual server.
3.4 Dedicated Servers
Dedicated servers provide exclusive physical hardware for the client. The client has full control over the server and is responsible for its administration, software maintenance, and security.
3.5 Additional Services
We offer complementary services including: SSL Certificates for website encryption, Domain registration and transfer, Professional email services, Website building tools, Web security solutions (SiteLock), Automated backups (CodeGuard), and VPN services.
3.6 Uptime Guarantee
Unknown Server commits to maintaining 99.9% monthly network availability. This guarantee excludes: scheduled maintenance (notified in advance), force majeure circumstances, denial of service attacks (DDoS), client actions causing unavailability, and issues with external providers.
4. USER REGISTRATION AND ACCOUNT
4.1 Eligibility
To use our Services, you must: be at least 18 years of age or the legal age of majority in your jurisdiction, have the legal capacity to enter into binding contracts, provide true, accurate, current, and complete registration information, and not have been previously suspended or removed from our Services.
4.2 Account Information
When registering, you agree to provide truthful, accurate, and up-to-date information, including full legal name, valid email address, verifiable physical address, contact phone number, and valid payment information. You are responsible for keeping this information current.
4.3 Account Security
You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any security breach. Unknown Server will not be liable for losses caused by unauthorized use of your account.
5. PAYMENTS AND BILLING
5.1 Pricing and Fees
Prices for our services are published on our website and are subject to change. Displayed prices may not include applicable taxes, which will be added as appropriate. Price changes for existing services will be notified at least 30 days in advance.
5.2 Payment Methods
We accept various payment methods including major credit/debit cards, PayPal, bank transfers, and other methods we may offer. You authorize automatic charging of applicable fees to the registered payment method.
5.3 Billing Cycles
Services are billed in advance according to the selected billing cycle (monthly, quarterly, semi-annual, or annual). Invoices are issued before the expiration of the current period and payment must be made before the due date.
5.4 Late Payments
In case of non-payment by the due date: a payment reminder will be sent, after 3 days of delay, the account may be suspended, after 14 days of delay, the account may be terminated and data may be deleted. Unknown Server is not responsible for data loss resulting from termination due to non-payment.
5.5 Automatic Renewal
Services will automatically renew at the end of each billing period unless cancelled before the renewal date. You can disable automatic renewal from your control panel at any time.
6. ACCEPTABLE USE POLICY (AUP)
6.1 Prohibited Use
It is strictly prohibited to use our Services for:
• Illegal content: distribution of material that violates local, national, or international laws.
• Child abuse material: any content that exploits or harms minors.
• Spam and unsolicited marketing: sending mass unsolicited emails.
• Malware and malicious software: distribution of viruses, trojans, ransomware, or other harmful software.
• Phishing and fraud: websites designed to deceive users and obtain sensitive information.
• Copyright infringement: unauthorized distribution of copyright-protected material.
• Network attacks: launching DDoS attacks, unauthorized port scanning, hacking.
• Hate content: material that promotes violence, discrimination, or incitement to hatred.
• Cryptocurrency mining: without express prior written authorization.
• Open proxies and TOR services: operation of open proxies or TOR exit nodes.
6.2 Resource Usage
On shared hosting plans, resources must be used reasonably. Unknown Server reserves the right to limit or suspend accounts that consume excessive resources affecting other users. Excessive use includes: CPU usage that consistently exceeds plan limits, exceeding allocated disk space or bandwidth, running processes that negatively impact server performance.
6.3 Reseller Client Responsibility
Clients with Reseller plans are responsible for ensuring that their own customers comply with this AUP and all our Terms. Non-compliance by end customers may result in suspension or termination of the Reseller account.
7. CANCELLATIONS AND REFUNDS
7.1 Money-Back Guarantee
We offer a 30-day money-back guarantee for new customers on shared hosting plans. This guarantee is subject to: being the first service contracted with Unknown Server, requesting the refund within the first 30 days from activation, and not having violated our Terms of Service.
7.2 Guarantee Exclusions
The money-back guarantee does NOT apply to: registered or transferred domains, SSL certificates, Reseller plans, VPS and dedicated servers, additional services (backups, security, etc.), renewals of existing services, and custom services or special configurations.
7.3 Cancellation Procedure
To cancel a service, you must submit a cancellation request through your control panel or by opening a support ticket. Cancellations must be requested at least 7 days before the next billing date to avoid additional charges. Cancellations requested by phone or social media will not be processed.
7.4 Refunds
Eligible refunds will be processed within 14 business days using the original payment method when possible. Unknown Server reserves the right to deduct the costs of any free domain included in the plan.
8. SUSPENSION AND TERMINATION
8.1 Suspension by Unknown Server
Unknown Server may immediately suspend without prior notice any account that: violates these Terms or the AUP, poses a security threat to our network or customers, generates legitimate third-party complaints, has pending or rejected payments, or is required by court order or government authority.
8.2 Termination by Unknown Server
We reserve the right to terminate any account for serious or repeated violations of these Terms, illegal activities, prolonged non-payment, at our reasonable discretion when necessary. In case of termination for Terms violation, no refunds will be granted.
8.3 Effects of Termination
Upon termination of an account: access to services will be revoked immediately, stored data may be permanently deleted after 7 days, we have no obligation to maintain or provide copies of your data, any outstanding balance must be paid in full.
9. INTELLECTUAL PROPERTY
9.1 Client Content
You retain all intellectual property rights to your User Content. By using our Services, you grant us a limited license to host, store, transfer, and display your content solely for the purpose of providing the contracted Services.
9.2 Unknown Server Property
All rights, titles, and interests in our website, platform, software, trademarks, logos, and original content remain the exclusive property of Unknown Server. Nothing in these Terms grants you rights to our intellectual property.
9.3 DMCA Notices
Unknown Server respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been copied in a way that constitutes infringement, you may send us a DMCA notice through our contact form.
10. LIMITATION OF LIABILITY
10.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". UNKNOWN SERVER EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Damages
IN NO EVENT SHALL UNKNOWN SERVER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.3 Maximum Liability Cap
Our total liability to you for any claim related to these Terms or the Services shall not exceed the total amount paid by you to Unknown Server during the 12 months preceding the event giving rise to the claim.
10.4 Specific Exclusions
Unknown Server shall not be liable for: data loss (you are responsible for maintaining backups), damages caused by third parties or end users, service interruptions outside our control, actions of external or upstream providers, security vulnerabilities in third-party software.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Unknown Server, its directors, employees, agents, and providers from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: your use of the Services, your violation of these Terms, your violation of third-party rights, your User Content, any activity conducted through your account.
12. BACKUPS
Although Unknown Server may perform periodic backups of server data, YOU ARE SOLELY RESPONSIBLE for maintaining adequate backups of your content. We strongly recommend: performing regular backups of all your data, downloading and storing copies in external locations, using our additional backup services (CodeGuard) for greater protection. Unknown Server does not guarantee the availability, integrity, or recoverability of any backup.
13. TECHNICAL SUPPORT
Unknown Server provides 24/7 technical support through our ticket system. The scope of support includes: hosting infrastructure-related issues, basic account and control panel configuration, network connectivity issues, and billing and account inquiries.
Support does NOT include: website development or modification, custom code debugging, performance optimization of third-party applications, or support for software not installed by Unknown Server.
14. SERVICE MIGRATION
We offer free migration services for new customers, subject to: one migration per new account, standard websites compatible with our systems, availability of our technical team. Unknown Server does not guarantee migration success and will not be liable for issues arising during or after the migration process.
15. MODIFICATIONS TO TERMS
Unknown Server reserves the right to modify these Terms at any time. Significant changes will be notified at least 30 days in advance via email or notice on our website. Continued use of the Services after the effective date of modifications constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must cancel your account before the effective date.
16. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with applicable laws, without giving effect to any principles of conflicts of law. Any dispute arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts.
17. GENERAL PROVISIONS
17.1 Entire Agreement
These Terms, together with the Privacy Policy and any additional policies posted on our website, constitute the entire agreement between you and Unknown Server regarding the Services.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver
The failure of Unknown Server to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. Unknown Server may assign these Terms without restriction.
17.5 Force Majeure
Unknown Server shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, wars, acts of terrorism, pandemics, power outages, telecommunications failures, or government actions.
